Pengantar Program Retensi Jangka Panjang Tenaga Kerja Asing Terampil


Untuk melengkapi tenaga kerja industri, Kementerian Ketenagakerjaan secara resmi memberlakukan “Program Pekerja Migran Jangka Panjang” sejak 30 April 2022. Untuk manufaktur, pejagalan, pertanian dan perawatan jangka panjang serta sektor lainnya yang telah mempekerjakan pekerja migran, dapat mempertahankan pekerja migran senior yang telah bekerja di Taiwan selama 6 tahun ke atas atau pelajar asing/Tionghoa Perantauan yang mendapat gelar ahli madya ke atas di Taiwan, memenuhi persyaratan gaji dan keterampilan, maka pemberi kerja dapat mengajukan peralihan menjadi tenaga kerja teknis menengah. Tenaga kerja teknis menengah tidak dibatasi lama tahun kerja di Taiwan, kenaikan gaji, keterampilan semakin meningkat, dan tidak perlu lagi membayar biaya stabilitas ketenagakerjaan, di masa mendatang mereka yang bekerja genap 5 tahun akan dapat terhubung dengan sistem izin tinggal permanen.


Tenaga kerja teknis menengah tetap terus mendapat jaminan asuransi tenaga kerja dan asuransi kesehatan, tenaga kerja teknis menengah sektor industri yang tunduk pada Undang-Undang Standar Ketenagakerjaan juga dapat menggunakan sistem pensiun lama pada saat pensiun di Taiwan nantinya. Setelah pemberi kerja yang mengajukan permohonan peralihan pekerja migran menjadi tenaga kerja teknis menengah, selain dapat mempertahakan tenaga kerja dengan ketrampilan yang sesuai dengan kebutuhan, kuota asal pekerja migran setelah beralih ke tenaga kerja teknis menengah masih tetap dapat digunakan untuk merekrut lagi pekerja migran yang baru, sehingga secara keseluruhan jumlah pekerja migran yang dipekerjakan bertambah, dapat membantu kebutuhan akan tenaga kerja.

The regular monthly salary is higher than NT$33,000, or the total annual salary is more than NT$500,000. Regular monthly salary is higher than NT$30,000 for the initial employment of foreign students, overseas Chinese students or other ethnic Chinese students who graduated from schools of higher education and earned the associate bachelor degrees in Taiwan, and the salary level resumed to NT$33,000 for renewed employment.

Satisfy any of the following requirements: 
1. Professional license or certificate: passed the agricultural technical qualification intermediate level examination, the planning should include: (1) rudimentary level capacity in fruit tree plantation management. (2) Rudimentary level capacity in facility agriculture work management. (3) Rudimentary level capacity in tea plantation management. (4) Rudimentary level capacity in sugar apple plantation management.(5) Rudimentary level capacity in rice plantation management. 
2. Training programs: Experimental and improvement farms under the Council of Agriculture, or professional technical training programs organized by schools of higher education and industry association delegated by the Council of Agriculture for more than 80 hours of training in accumulation. 
3. Confirmation of practical work: The employers shall present the document for proof of conforming to the requirement of mid-level technical skill of the migrant workers (including the certification documents and video showing the performance of work) and petition with the Council of Agriculture in conformity to requirements and review mechanisms recognized by the Council of Agriculture. 

Foreigners who earned regular salary of more than NT$35,000 are free from the technical skill requirements.

Isi :

1. Foreign students, overseas Chinese students, or other ethnic Chinese students who have graduated from the schools of higher education in Taiwan and earned the associate bachelor degrees, and meet the salary requirement and technical requirement of mid-level human resources. 
2. Those who have been employed in Taiwan for 6 consecutive years with no record of law violation, and meet the salary requirement and technical requirement of mid-level human resources. 
3. Migrant workers who have been working for more than 6 years cumulatively and departed, and then return to Taiwan for employment whose years of seniority meet the requirement of the duration of employment pursuant to Article 52 of the Employment and Service Act (14 years for home nursing care personnel, and 12 years for all other industries), and who meet the salary requirement and technical requirement of mid-level human resources. 
4. Migrant workers who have been working in Taiwan for more than 12 years cumulatively and have no record of law violation and then departed, but meet the salary requirement and technical requirement of mid-level human resources.

Quota for agricultural employers (limited to orchid, mushroom and vegetable) and shall meet the following requirements: 
1. Approved ratio of 35%*0.25 
2. The total number of migrant workers, foreign mid-level technical personnel, and foreigners engaged in professional duties shall not exceed 50% of the total employee population. 

Employers in extensive farming should also meet the following requirements: 
1. The number of persons approved by the central competent authority administering the function *0.25 
2. The total number of migrant workers, foreign mid-level technical personnel, and foreigners engaged in professional duties shall not exceed 50% of the total employee population.

Agricultural (limited to orchid, mushroom and vegetable) employers engaged in the plantation of orchid, edible mushroom, vegetable and crops related work. 
Employers in extensive farming is classified as cooperatives or non-profit organizations of the farmers association, fisherman association, and agricultural, forestry, fishery and live stock farming, and present the extensive farming service plan to the central competent authority administering the function for approval.
