Work hours, day off, and (request for) leave for returning to home country


Detail :

1. Work hours: the work hours for migrant workers in by industry shall be governed by the Labor Standards Act. Work hours for maids/caregivers shall be governed by the employment agreement binding the employer and the employee. The number of days for holidays, the calculation of salaries for taking no leave, and the method of payment, shall be agreed upon by the employer and the migrant worker and inscribed in the employment agreement caused by both sides in full agreement. The employer shall duly observe the terms and conditions specified in the employment agreement.
2. Annual leave: migrant workers in the industrial sector or maids /caregivers entitled to annual leave under the Labor Standards Act or the employment agreement within the perpetuity of the employment permit may request leave for returning to their home country for a holiday and shall arrange the time for returning at the consent of the employer. However, the employer may consult with the foreigner for adjusting the schedule of returning to home country if there is an urgent need in business operation or the recipient of caregiving.  If the schedule cannot be adjusted, the employer shall agree with the original schedule of the foreigners for returning to their home country.
