▍How much do you know about the rights of pregnant foreign workers?

•Being pregnant does not affect your right to work:Foreign workers who fall pregnant while working in Taiwan are allowed to continue working and employers cannot fire them for being pregnant. At the same time, employers are required to provide a suitable work environment to ensure the health and safety of the pregnant worker.

•You can apply to transfer employers:If you need to transfer employers while pregnant, you can talk to the employer about agreeing to terminate your employment relationship, and apply to the Ministry of Labor for a transfer. If you need to temporarily pause a transfer, on provision of a medical certificate or a pregnancy health handbook an extension will be provided until up to 60 days after the end of the pregnancy. Once the pregnancy has ended the foreign worker can continue to work in Taiwan and apply to recontinue the employer transfer process. If approved by the Ministry of Labor a further extension of 60 days can be granted.

•Legal right to take leave:Pregnant foreign workers can legally apply for prenatal rest leave, prenatal check-up leave and maternity leave. If a foreign worker’s spouse is pregnant or giving birth, the employer should also provide accompaniment leave for prenatal check-ups and paternal leave, to ensure couples experience this important life moment together.
