▎What happens if a foreign worker has not used up all his or her annual leave at the end of the year?

Have it converted into salary

Based on the Labor Standards Act, if a worker has not used up all his/her annual leave by the end of the year, the remaining days can be converted into salary.

Extend the period over which annual leave can be used

If employers and workers agree, unused annual leave can be carried over and used the following year. When taking annual leave the next year priority will be given to using those days from the previous year.

When you are a live-in care worker and your labor contract contains provisions on annual leave, if you do not use up all your annual leave days in a given year, talk to your employer about whether “annual leave not used that year” can be converted into salary or carried over and used the next year.
