<1. Summary of the case>
In March 2024, Chen X, the president of Dah XX Company, commanded the laborer Lin X to drive the victim A X SA to the work site on Guang Xing Road, Taiping District in Taichung City for training. When the laborer Lin X engaged in the condenser installation on the second floor, he found that he did not have a screwdriver with locking tapping screws, so he returned to the first floor to get the tools. While moving between the staircases, he heard a crash on the first floor. Then he found the victim had already fallen on the first-floor ground. Finally, the victim was sent to hospital for treatment and died.
<2. Causes of hazards>
The employer failed to plan a safe route to the roof frame, install a solid grille or safety net and other fall prevention facilities under the roof, designate a supervisor to direct the roofing operation. He failed to provide the victim the helmets, safety belts, and other necessary protective gears, which resulted in the victim stepping through the lighting cover and falling from a height around 3.43 meters to the ground. The victim had a head injury with a subdural hemorrhage on the right side and a fracture of the cranial bone, and acute respiratory failure. He died in the hospital after receiving medical treatment.
<3. Protective Measures for Hazards>
(1) Employers should adopt the following facilities to prevent workers from falling through the roofs and rain shelters constructed with materials that are easy to be stepped through, such as sponges, tin plates, tiles, wooden boards, thatches, plastics, etc. They should also prevent workers from stepping through and falling through the interlayer ceilings constructed with materials that are easy to be stepped through, such as minerals fiber boards, gypsum boards, etc.1. Plan safe pathways and set up treads with appropriate strength and a width of at least 30 centimeters on the roof frames, rain shelters, or ceiling frames.2. Install a solid grille or safety net in the area where the roof frame, rain shelter, or ceiling may fall.3. Assign a supervisor to direct or supervise the roofing operation.
(2) Employers should ensure workers to use safety belts, helmets, and other necessary protective gears when working at heights of more than 2 meters and workers are in danger of falling, unless the employer adopts safety nets and other measures.
