活動訊息:MOL’s solutions for the Filipino ban on migrant worker export to Taiwan

In response the Filipino ban on migrant worker exporting to “China, Hong Kong, Macau, and Taiwan” enacted as of zero hundred hours on February 10, which will affect the rights and interests of Taiwanese employers, MOL allows affected employers to apply for extension and re-entry of existing Filipino migrant workers or for replacement with migrant workers of other countries. According to MOL, this notice covers the following emergency situations: (1) inability to import recruited Filipino migrant workers; (2) inability to reinstate of Filipino migrant workers returning the Philippines for family visits; (3) inability to leave Taiwan as scheduled due to flight cancellation or rescheduling, resulting in a breach of departure schedule. MOL has planned related solutions as tabulated below for employer to selection. Situation Solution Inability to import recruited Filipino migrant workers As the ban of the Filipino government conforms to the “force majeure” term, employers may submit a statement to the MOL to apply for import extension of 3 months. Inability to reinstate of Filipino migrant workers returning the Philippines for family visits 1. Continue to employ the same migrant worker(s): If the migrant worker(s) is(are) unable to return to Taiwan by the re-entry deadline, employers may apply to the MOL for the re-entry of the migrant worker(s). 2. Replace a migrant worker: After applying for rescission of the original permit, employers may apply for hiring migrant workers from other countries to according to the related regulations. Inability to leave Taiwan as scheduled due to flight cancellation or rescheduling, resulting in a breach of departure schedule. 1. If the “one out and one in” or “departure after expiration” (submit the original flight ticket booking records as evidence) policy is not breached. 2. Employers shall send the migrant worker(s) back to the Philippines as quickly as possible. If there are worries about the cancellation of Taiwan-Philippines direct flights, take flights of a Filipino national airline or transit via a third location. In addition, employers shall take good care of migrant workers with due diligence before their departure. According to MOL, the ban is a “force majeure” event with nobody’s responsibility, related government departments shall process applications as quickly as possible with a lenient approach to help employers complete the follow-up procedures, in order to maintain the rights and interests of both employers and migrant workers. Moreover, MOL will coordinate with the Ministry of Foreign Affairs to consult with the Filipino government regarding the ban on migrant worker ban.
