Protecting the rights of female foreign workers and their children at all stages
The Ministry of Labor has established “Guidelines to protect the rights of female foreign workers and their children,” based on existing regulations. These bring together support resources across pre-natal, pregnancy, postpartum, and childcare stages with information available in Chinese, English, Thai, Indonesian and Vietnamese. In this way, foreign workers, employers and labor brokers can work together to create a harmonious work environment.
Pre-natal : Promote safe contraception use, family planning, and healthcare rights
During pregnancy :
•Employers cannot unilaterally terminate employment
•Respect the right of foreign workers to take leave when pregnant (bed rest leave, pre-natal check-up leave, maternity leave, spousal pre-natal check-up leave and paternity leave).
•Temporary postponement of employer transfers and emergency placements
•Measures to protect health rights (such as pre-natal check-ups)
Postpartum :
•Labor insurance maternity benefits
•Use of National Health Insurance
•Respect the right of foreign workers to take postpartum leave (maternity leave, spousal pre-natal check-up leave and paternity leave)
•Employers can apply for respite and short-term care services
Childcare (infants and children) :
•Family care leave and time to breastfeed
•Unpaid parental leave
•Related rights of foreign workers' children (residence, vaccination etc)
