活動訊息:Three tips on legal employment from the Ministry of Labor

If you are an employer or proprietor, do you know what you must do before you hire someone of foreign nationality as your employee? The Workforce Development Agency of the Ministry of Labor has three simple tips for you: “Check, Verify and Ask”.

Before you hire a foreigner, “Check” their ARC or work permit (be sure to ask for original copy); “Verify” their documentations to make sure that he/she is the same person as shown in the documentations and “Ask” whether they are a new resident, a foreign student or an immigrant worker.

By going through this three-step process, you will protect yourself against potential violations and relevant penalties.

According to the Agency, employers are required to apply for a work permit before hiring a person of foreign nationality; foreign students with a valid work permit issued by the Ministry of Labor are eligible to seek employment.

It is imperative that employers request and verify job seekers’ ARC/student identification prior to official employment.

If you have a job seeker who claims to be a new resident, even though they are not technically required to apply for a work permit from the Ministry of Labor, you must still check the original copies of ARC, passport and household registration that proves their status as a dependent while carefully verifying their picture and relevant identification to avoid hiring someone using fake identity as this could lead to a maximum fine of NT$ 750,000.

In addition, the Agency also noted that foreign home care workers are only permitted to perform tasks that strictly involve caregiving in household environments for their care-receivers by helping them with relevant day-to-day activities and cleaning.

Similarly, foreign workers hired for manufacturing operators at production facilities may only be involved in the jobs they have been hired to perform in the official capacity as declared.

In other words, employers who ask foreign care workers to perform other business related tasks, such as assigning any duties to them to work at premises they operate or asking factory workers to perform janitorial duties at their own homes may face a fine of up to NT$ 150,000.
